REFUND & CANCELLATION POLICY

Effective Date: Feb 16, 2024

By purchasing and maintaining a subscription with Capitallyst Pro, you acknowledge and agree to the following terms, which govern all subscription plans and payments. These terms are binding and enforceable under applicable law.

1. No Refunds (General Policy)

Capitallyst Pro maintains a strict no-refund policy for all subscription payments, except as expressly provided in Section 2 (Annual Subscription Grace Period). All fees, including subscription fees, setup fees, and any additional service charges, are non-refundable once processed.

2. Annual Subscription Grace Period

For annual subscriptions only, customers are eligible to request a prorated refund if:

- The request is made within 30 days of the initial subscription purchase or annual renewal date, and

- The account has not been materially used during that period (as determined by Capitallyst Pro’s usage logs).

Prorated refunds, if approved, will be subject to deductions for:

- Non-refundable setup fees,

- Services rendered, including onboarding, consulting, and customization,

- Administrative and processing fees incurred to manage the cancellation.

After this 30-day grace period, no refunds will be issued for any reason. Access to services will continue until the subscription term ends.

3. Month-to-Month Subscriptions

Month-to-month subscribers may cancel at any time.

Cancellations take effect at the end of the current billing cycle (monthly anniversary date).

No refunds or prorated credits will be provided for partial months or unused time.

4. Setup Fees & Additional Charges

All setup fees are final and non-refundable.

Capitallyst Pro reserves the right to deduct or bill for any outstanding charges, custom work, professional services, or additional usage costs incurred prior to cancellation.

5. Chargebacks & Disputes

Initiating a chargeback or payment dispute without first contacting Capitallyst Pro to resolve the matter constitutes a breach of these terms. Capitallyst Pro will submit all supporting documentation, including signed agreements and usage records, to the payment processor or financial institution to dispute and reverse unauthorized chargebacks. Customers initiating unwarranted chargebacks may be subject to collection efforts and liability for any fees or damages incurred by Capitallyst Pro as a result.

6. Cancellation Process

To cancel your subscription, you must:

- Log in to your Capitallyst Pro account.

- Navigate to the account settings and follow the cancellation instructions.

- Submit cancellation prior to your next billing date to avoid charges for the upcoming cycle.

7. Acknowledgment

By activating or renewing a subscription, you acknowledge that:

- You have read and understood this policy,

- You agree that all fees are non-refundable except as expressly stated herein,

- You waive any right to claim a refund or initiate a chargeback outside the parameters of this policy.
